Applicant Privacy Policy
At GXS, we are committed to protecting your privacy. You should know that the personal information you provide to us as an applicant for a position with GXS (the "Candidate Data" or "Data") will be collected, used and retained in accordance with your legal rights under state and Federal law.

Candidate Data may include, but is not limited, to: your immigration and current employment status, work history/job data, education, former or present compensation, former or present employer feedback and online questionnaire results. This list is not exhaustive and may be changed or added to from time to time. In order for GXS to collect and process this information, we need your acknowledgment of the following principles:

  1. You have reviewed the Candidate Data Privacy Guidelines below.
  2. You understand that GXS will process the Candidate Data for the recruitment purposes set out in the Candidate Data Privacy Guidelines.
  3. You acknowledge that GXS is an international organization and that the Candidate Data may be transferred worldwide, again in accordance with our Candidate Data Privacy Guidelines.
  4. You hereby consent to provide the Candidate Data in order that GXS may complete the process of considering your employment.
When submitting your application online, if you do not agree to any of the foregoing, click on the "X" button in the upper right-hand corner of the application page, and the submittal process will discontinue.

Candidate Data Privacy Guidelines
These guidelines are based on GXS's Guidelines on Employment Data Protection and Privacy, and are intended to inform you about the processing of Candidate Data. Unless noted otherwise, these guidelines do not form part of any contract of employment that may be offered to you. GXS reserves the right to amend these guidelines from time to time.

Data Privacy Principles
  1. Candidate Data will be collected and used for the limited purposes specified below.
  2. Data collected will be relevant to, and not excessive for, the purposes for which it is requested.
  3. Data will be as accurate as possible and, as necessary in accordance with applicable laws, kept up to date.
  4. Subject to legal requirements, Candidate Data will not be kept longer than appropriate or necessary.
  5. Appropriate technical and physical measures will be taken to protect Candidate Data from unauthorized access and accidental loss, destruction or damage.
Processing
GXS represents that it will process Candidate Data fairly and lawfully for the purposes of your potential employment (the "Purposes").

Processing for the Purposes includes obtaining, recording, holding, organizing, transferring, adapting, amending, recovering, limiting, disseminating or otherwise making available your Candidate Data as required to enable evaluation and decision-making. In addition, processing may include aligning, blocking, destroying and erasing Candidate Data when necessary or appropriate.

Information Collection
Subject to local legal requirements, GXS may use external service providers to collect, process and/or validate Candidate Data for the Purposes. GXS requires that any such external service providers ensure adequate protection for Candidate Data and comply with local legal requirements.

GXS may periodically collect further information with your consent or in accordance with applicable laws. For example, GXS may collect your feedback and opinions (e.g., surveys) for business purposes such as improving internal processes. Your response to these surveys is voluntary. In either event, rest assured that you will not suffer reprisals in connection with such surveys.

Disclosure Within GXS
To operate as a global business and to promote your career within GXS, it may be necessary to process and transfer Candidate Data within our worldwide operations. This may involve transferring Candidate Data outside the country in which you submit the data.

Processing, transfer and/or release of Candidate Data within GXS or to third parties outside your country of submission is subject to local law and, where required, to your consent.

Disclosure Outside of GXS
Under certain circumstances, GXS may be obligated to disclose Candidate Data to third parties, such as government authorities, in accordance with applicable laws.

It may also be necessary to disclose certain Candidate Data to a supplier or contractor organization supplying services that require the use and/or creation of Candidate Data for the Purposes and in accordance with applicable laws.

Last, we may need to disclose Candidate Data in order to demonstrate our compliance with laws governing employment and recruiting practices, or to fulfill other legal obligations of GXS.

Candidate Data Security
GXS ensures adequate security to protect both manual and electronic processing of Candidate Data to prevent its misuse or unlawful disclosure.

As part of our security process, we separate Candidate Data into different categories according to type and sensitivity, as appropriate, and in accordance with applicable local legal requirements for the categorization of private data.

GXS also ensures that third parties and affiliates who process or otherwise come into contact with Candidate Data observe similarly adequate security measures.

Sensitive Candidate Data
GXS acknowledges a special category of Candidate Data that may be entitled to enhanced protection ("Sensitive Data"). Sensitive Data includes, but is not necessarily limited to:

  1. Demographic data (e.g., sex, race, color, ethnic or national origin, religion, philosophical or political beliefs, trade union membership and criminal history)
  2. Medical data (e.g., pre-placement medicals and/or drug screens, or other medical documents produced for the purpose of employment)
  3. Personal financial data

GXS may process this type of data: (a) for the purposes of equal opportunities monitoring; (b) where needed for the protection of life, health or freedom; and (c) where required for the performance of any employment contract offered to successful hires, all subject to appropriate security safeguards and in accordance with applicable local legal requirements.

When required to do so by law, GXS will obtain your explicit consent before processing Sensitive Data.

Your Submission and Subsequent Access to Candidate Data
You may use various methods to submit information to GXS. These may include online résumé submittal via a third-party service provider, which will be deposited into a US-based electronic database, or submittal via a GXS employment application.

If your Candidate Data is held in an electronic database, you have the right to view the data (subject to legal limitations and requirements). If you would like to view your Candidate Data for any reason, please send a request in writing to the:

The Human Resources Data Protection Administrator will respond as promptly as possible to confirm your right of access and make the information available for your review at a mutually agreeable time and place.


Updating Your Data
GXS makes all reasonable efforts to maintain the accuracy of the Candidate Data, but you are encouraged to assist in ensuring that the information is kept up to date by amending or removing Candidate Data that is inaccurate or out of date.

GXS will endeavor to promptly address and resolve any issues you identify concerning your Candidate Data and notify you when such corrections or updates are put into effect.
